These Terms of Service ("Terms") govern your use of the TapNGame mobile app (the "App") and the website at tapngame.com (the "Site," together the "Platform") operated by Sportster Technologies Inc. ("TapNGame," "we," "us," "our"). By creating an account or using any part of the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 18 years old to create an account and use the Platform. By signing up, you confirm that you are at least 18, that the information you provide is accurate, and that you are legally able to enter into this agreement. If we learn that an account belongs to someone under 18, we will close it.
2. Your Account
You can create an account with email and password, Sign in with Apple, or Google Sign-In. You are responsible for keeping your login credentials confidential and for everything that happens under your account. Notify us promptly at support@tapngame.com if you suspect unauthorized access. One person may hold one account; you may not impersonate another person, share your account, or transfer it to someone else.
3. The Service
TapNGame helps players discover and book sports venues and organize pickup games in their city. Through the Platform you can:
- search and book courts, fields, and rinks at partner venues;
- host or join pickup games organized by other players;
- create or join communities, post updates, and chat with other players;
- rate and review games, players, and venues you have played with;
- send and accept friend requests and invite friends to games.
We may add, change, or remove features at any time. We will give reasonable notice of material changes that affect paid bookings or stored content.
4. Bookings and Payments
4.1 Court bookings
When you book a court at a partner venue, you enter a contract with the venue for that booking. TapNGame facilitates the booking and the payment but is not the provider of the venue space. The venue's cancellation policy is shown before you pay and is incorporated into your booking. The price you see at checkout is the final price (taxes included where shown).
What you pay vs. what the venue receives. The price you pay at checkout includes the venue's listed rate plus any applicable sales tax (GST/HST and, where applicable, provincial sales tax) shown as a separate line. TapNGame collects this total through Stripe and routes the payment to the venue. We deduct our platform fee from the venue's share — it is not added on top of your price and is not a separate charge to you. The tax you pay is routed to the venue together with the booking; the venue (not TapNGame) is the merchant for the underlying sports facility and is responsible for remitting your tax to the relevant tax authority under its own registration.
4.2 Pickup-game costs
When a host creates a pickup game, they may enter a "cost per player" figure to indicate that participation involves out-of-pocket costs (for example, splitting a court rental, equipment, or refreshments). This figure is shown for transparency only. TapNGame does not collect, hold, settle, or refund any money for pickup games. Any payment between a host and a player is a private arrangement between them and is settled directly, off-platform. You are solely responsible for resolving any dispute about a pickup-game cost with the other player or host involved.
4.3 Payment processor (venue bookings)
Payments for venue bookings are processed by Stripe. Card details are entered directly into the Stripe payment sheet on your device and never pass through our servers. By paying a venue through TapNGame, you also agree to the Stripe Services Agreement.
4.4 Cancellations and refunds
Refund eligibility for venue bookings depends on the venue's cancellation policy and how far in advance you cancel. Full details, timelines, and the dispute process are in our Refund Policy, which forms part of these Terms. Pickup games are not covered by the Refund Policy because TapNGame does not collect game costs.
5. Pickup Games and Reliability
Pickup games are organized by individual hosts who set the location, time, sport, and skill level. TapNGame is not the organizer of any game and does not supervise gameplay. Participation is at your own risk.
We track basic reliability signals to keep games fair: a no-show is recorded if you join a game and do not arrive, and repeated no-shows lower a public reliability score on your profile and may temporarily restrict your ability to join games. Hosts are expected to honour the games they create or cancel them with reasonable notice.
6. Your Content
6.1 What counts as your content
"Your Content" means anything you post, upload, or send through the Platform — including profile information, photos, posts, comments, community pages, chat messages, ratings, and reviews.
6.2 Ownership and licence
You keep ownership of Your Content. By submitting it, you grant TapNGame a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for technical reasons such as resizing), display, and distribute Your Content solely to operate, promote, and improve the Platform. The licence ends when you remove the content or close your account, except for copies already shared with other users (for example, a chat message someone else has received) and for backups, audit, or legal records.
6.3 Your responsibilities
You confirm that, for everything you post:
- you own it or have the right to share it;
- it does not infringe anyone's copyright, trademark, privacy, publicity, or other rights;
- it does not contain people who have not agreed to be in it, particularly children.
7. Acceptable Use
Sports communities only work when people behave well. You agree not to:
- post content that is hateful, harassing, threatening, sexually explicit, violent, illegal, or that targets anyone based on race, religion, gender, sexual orientation, disability, or other protected characteristic;
- bully, dox, stalk, or impersonate anyone, on or off the Platform;
- share misleading information about a venue, a game, or a player;
- manipulate ratings, reviews, friend counts, the reliability score, or other Platform signals;
- spam other users, mass-message, or send unsolicited promotions in chats, posts, or communities;
- use the Platform for commercial purposes that we have not authorised, including reselling bookings or running paid competing services;
- attempt to access another user's account, scrape or copy the Platform, reverse-engineer the App, or interfere with our security or infrastructure;
- upload viruses, malware, or anything designed to disrupt the Platform or other users' devices;
- break any law that applies to you while using the Platform.
These rules apply to every surface of the App, including profiles, chats, posts, communities, ratings, and game and venue reviews.
8. Reporting, Moderation, and Enforcement
We have zero tolerance for objectionable content or abusive users. Content that violates Section 7 — including hateful, harassing, sexually explicit, violent, or illegal material — is not permitted on the Platform, and accounts that post or send it will be removed.
Every user-generated surface of the App lets you report a user, post, comment, message, community, or game, and lets you block any other user. We aim to review reports of objectionable content within 24 hours and to act on confirmed violations promptly. We may remove content, temporarily restrict an account, or permanently terminate an account for violations of these Terms, with or without notice. Severe or illegal content (for example, content exploiting minors) is removed immediately and may be reported to law enforcement.
You can also block another user from your profile or any conversation. Blocking hides that user's content from you on the feed, in communities, and in search.
If you believe an action against your account was a mistake, email support@tapngame.com and we will review it.
9. Ratings and Reviews
Ratings and reviews must reflect your honest experience. You may not pay for, solicit, or trade ratings, post reviews about games or venues you did not attend, or coordinate to lower another user's reputation. We may remove reviews that violate these Terms or that appear to be inauthentic.
10. Notifications
With your permission, we send push notifications about bookings, games you have joined, chat messages, friend requests, and rating prompts. We also send transactional emails for booking confirmations, password resets, and account verification; these cannot be opted out of while you have an active account. We do not send marketing emails or marketing push notifications without a separate opt-in. You can disable push notifications at any time from your device settings or in the app under Settings → Notifications.
11. Venues and Other Third Parties
Partner venues are independent businesses, not employees or agents of TapNGame. They are responsible for the safety, cleanliness, equipment, and condition of their facilities. Sports activities are physically demanding; you participate at your own risk and should consult a physician if you have any concern about your fitness to play.
Some features rely on third-party services such as Stripe, Apple Push Notification service, Firebase Cloud Messaging, Google Maps, and Sign in with Apple or Google Sign-In. Their terms may apply to your use of those features.
12. Intellectual Property
The Platform, including the TapNGame name and logo, the App, the Site, and all software, designs, text, graphics, and other materials we provide, is owned by Sportster Technologies Inc. or its licensors and is protected by Canadian and international intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for the purposes described in these Terms. All other rights are reserved.
12.1 DMCA notice of claimed infringement
We comply with the United States Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Platform infringes your copyright, send a notice to our registered Designated Agent:

A valid notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) the URL or other location of the allegedly infringing material on the Platform; (d) your contact information (address, phone, email); (e) a statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
We respond to complete notices promptly and may remove or disable access to the material identified. We terminate the accounts of repeat infringers in appropriate circumstances. Knowingly material misrepresentations in a notice may expose the sender to liability under § 512(f).
13. Termination and Account Deletion
You can delete your account at any time from Profile → Settings → Account → Delete account in the App, at tapngame.com/account-deletion, or by emailing support@tapngame.com. What happens to your data on deletion is described in section 6 of the Privacy Policy.
We may suspend or terminate your account if you breach these Terms, if your account is used fraudulently, if a chargeback is filed against a payment, or if required by law. On termination, your right to use the Platform ends, but provisions intended to survive — including content licences already granted, payment obligations, intellectual property, limitation of liability, indemnity, and governing law — remain in effect.
14. Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that any specific game, venue, or player will meet your expectations. Sports involve inherent risk of injury; TapNGame is not responsible for what happens during a game.
15. Limitation of Liability
To the maximum extent permitted by law, TapNGame and its directors, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the greater of (a) the amounts you paid to TapNGame in the twelve months before the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100). Some jurisdictions do not allow these limits; in those jurisdictions, the limits apply only to the extent permitted.
16. Indemnity
You agree to defend, indemnify, and hold harmless TapNGame and its directors, officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the Platform, your content, your conduct toward other users or venues, or your breach of these Terms.
17. Apple App Store Terms
If you obtained the App from the Apple App Store, the following also applies. These Terms are between you and TapNGame, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product warranties, claims of non-conformity, or third-party intellectual property claims relating to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
18. Google Play Terms
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms.
19. Governing Law and Disputes
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict-of-law rules. The courts of Vancouver, British Columbia have exclusive jurisdiction over any dispute relating to the Platform or these Terms, except where local consumer protection laws give you the right to bring proceedings in your country of residence. You agree to first contact us at support@tapngame.com and attempt to resolve any dispute informally before starting a legal action.
20. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. If a change is material — for example a change to fees, refund eligibility, or how disputes are resolved — we will notify you in the App or by email at least 14 days before it takes effect, where reasonably possible. Continued use of the Platform after a change becomes effective means you accept the updated Terms.
